THE ROLE OF THE JUDICIARY IN THE ENTRENCHMENT OF VIABLE DEMOCRATIC CULTURE IN NIGERIA

Abstract

The judiciary constitutes the foundational pillar of any structured society and serves as the hallmark of constitutional democracy as well as the bulwark of the people against repressive government and deprivation of rights and privileges. Democratic culture is sustained through a robust judiciary which ordains how society should be governed. In Nigeria, the judiciary has played a significant role in sustaining democratic governance through its interpretative and adjudicatory functions. However, in discharging this constitutional mandate, the judiciary faces numerous challenges including unwarranted political interference with judicial processes, politicisation of judicial appointments, arbitrary transfer of judges, poor remuneration, inadequate funding and facilities, bureaucratic red tape, and lack of institutional frameworks to sustain judicial independence. This work adopts a doctrinal research methodology drawing upon statutes, case law, textbooks, journal articles, periodicals and newspaper publications. The study finds that the judiciary has demonstrated remarkable courage in several landmark decisions that have strengthened Nigeria's democratic culture. However, challenges such as executive interference, corruption, delay in the administration of justice, and conflicting judgments continue to undermine judicial efficacy. The study recommends strengthening judicial independence through constitutional guarantees, merit-based appointments, improved funding and facilities, enhanced technology adoption, and enforcement of judicial accountability mechanisms to ensure the judiciary effectively sustains Nigeria's democratic culture.
