Abstract

This paper reviews varied uses of the conception of punishment in relation to non-custodial rulings, including the constantly- made comparison between punishment and recuperation. It concludes that punishment has no stable meaning in respect of similar rulings and, when utilised, frequently results in non-custodial penalties being found wanting by comparison with imprisonment. It's suggested that all rulings should be regarded as punishment, and that the creative development of community penalties will best be achieved by working with a tripartite conceptualisation of restitution, recuperation, and incapacitation, set within applicable boundaries of proportionality. This paper gave a legal X-ray of the alternative measures to custodial punishment in combating crimes. The methodology adopted was the use of primary and secondary sources of materials. This paper recommended non-custodial punishment as a solution to the congestion in the correctional centers.
